Study For Adults' Guardianship System

Setting up the adults'guardianship system aims at protecting judge-disable adults .Since 60's of 20th century ,rich countries such as Japan ,Germany ,France ,England, American and so on, have reformed their adults'guardianship systems .Modern adults'guardianship system bears good fruits on the society with the principle of admiring human rights and"maintaining normal life".There have not emerged any doctrine stipulations on adults'guardianship system in our country until 80's of 20th century. Thanks to their stagnant legislative concepts, backward legislative technologies and minor feasibilities, these stipulations are now becoming increasingly incapable to meet with the requirements by the society entering aged-popularization stage.By way of analysing legislative principles on adults'guardianship system and west countries'originating and reforming of adults'guardianship systems , referring to the foreign advanced legal civilization ,the article is to seek to answer that, in China which now is on the way of developing market economy and faces aged-popularization problems ,how to balance the relationship between securing trade safety and protecting human rights, how to break the puzzle of adults'guardianship systems ,so as to open the door of adults'guardianship system reform and to raise the theory of creating our country's adults'guardianship systems.During recent years, similar viewpoints on adults'guardianship system are being created home and abroad ,but the study inside mainland still ends up with following the steps of foreign study conclusions and seldom consider actual practicability of adults'guardianship system. The author of the article attempts to do some researches on this thesis so that offering a few commonplace remarks by way of introduction.
