The Comparative Study On Cyber-security Legislation

Information technology plays a more and more important role in society.We almost do everything depending on network information technology.Meanwhile, problems of information security become increasingly prominent.Legislation of information security is so important for personal privacy,corporation interests and even state security.Losses have become heavier due to information security for recent years.The information security tends to be the most urgent question for not only individuals,enterprises but also for the country.How does this double-edged sword serve the society well? For this case,countries have legislated to protect information security.Overseas legislation of information security,in which America dominates,is relatively mature and the system is perfect after years' exploration.Some countries which are not developed economically also make a favorable attempt in legislation of information security.This paper concretely analyzes and summarizes protection to information infrastructure,closure of information,and damage preventing to information,punishment for information tort,management for information pollution and even regulations for information involving national security from American Laws as well as experiences on legislation of information security from some other countries.This paper sums up legislation of information in China through induction method. Information legislation of our country is not very systematic,which is mainly because the legislation is scattered in all relevant stipulations in laws and rules and protection to information safety is impeded.Furthermore,there are no programmatic documents made on information protection.Information security is not sufficiently protected from threatening.In this case,it is not conducive to the development of country.By researching legislation of information security in America and other countries, this paper aims to conclude the system,learn from advanced and scientific points and bring forward the author's several advices about legislation of information security, such as:prepare guideline documents on information security;especially,pay attention to legislative protection for information security of enterprises,which is an important premise for achieving information and national security.The author looks forward to giving some favorable thought for improving legislation of information in China.
