China's Mode Of Administrative Enforcement

Administrative Enforcement is the main means to protect the right to a legitimate and effective exercise of administrative activities and the normal conduct of the administrative law has failed to fulfil the obligations established by law or administrative body set relative to the administrative obligations,in accordance with the law adopted Mandatory measures to compel the discharge of its obligations or meet their obligations with the state of the same acts. As the coercive acts an important component part of the executive to enforce the protection of the implementation of administrative decisions,and promote administrative purposes,has reached an important value.And the enforcement of the court system has always been there with the involvement of the administration of justice system and the recognition of the executive authorities of the self-help implementation of the system.China through the efforts of the past 20 years has been formed "to apply for the courts to enforce the principle of the executive to enforce the exception of" administrative enforcement system.Although most scholars think:My current implementation of the judicial-led administrative enforcement system,"drawing on the useful experience of the countries composition is suitable for China's national conditions." But in fact,the existing administrative enforcement system congenital defects are in practice increasingly exposed,to be worthy of serious review of the past two years,Chinese scholars on the enforcement of the existing administrative system reform a useful exploration,and made a few different reform ideas,based on the academic analysis of the various reform programmes,and considered the impact on the enforcement of relevant factors,the paper proposed the establishment of an executive-led system of enforcement,and on the establishment of the system of concrete ideas,with a view to China's administrative enforcement system to improve the humble way.
