Legal Consideration On The Community Correction Developed In Inner Mongolia

The community correction is the trend of international judicial systems nowadays and is also the inexorable trend in the penal system development in China. At present, the pilot work for community correction are being carried out in 21 provinces, autonomous regions and municipalities of China. Inner Mongolia Autonomous Region is one of the two minority areas among them. Taken as a whole, all the pilot work for community correction is developed in some large and medium cities of China. How to develop the community correction in such minority areas as Inner Mongolia Autonomous Region is still a blank both in theory and practice. This paper summarizes the achievements of community correction in foreign countries and analyzes the existing achievements and disadvantages of first pilot provinces for community correction in China. Based on this, the practical problems of developing community correction in Inner Mongolia are discussed in this paper and then the related suggestions of improving the community correction are put forward, which acts as a positive exploration for setting up a community correction system fitting for Inner Mongolia autonomous region and according with modernization execution concept. This paper includes four parts. Part one is the practices in community correction. In this part the change of penalty ideas, and the theory origin, emergence and development and main types of foreign community correction system. Part two is the value ideas of community correction. The community correction reflects the civilization and progress of penalty and contains the value pursuit of justice, humanity and benefit. Therefore, the community correction is adopted by most countries of our times, and is also the effective mode of the present penalty system reform of China. Part three is the advantage and disadvantage of developing the community correction in Inner Mongolia. Inner Mongolia has special criminal policy and legislation of minority in China and also has certain society, personnel's team and working foundation of community correction. But a large number of problems exist, such as the idea, lag in legislations, shortage of funds and personnel, and large differences between cities, rural and pastoral areas. Part four is the ideas on the legislation of regional community correction in Inner Mongolia. Aimed at the present situation of Inner Mongolia, it is proposed that the regional legislation should be followed in Inner Mongolia first. At the same time, the community construction should be accelerated and attempt should be made in new forms of community correction.
