Report On Rural Land Expropriation Dispute In Jiaohe City

Land acquisition is a special kind of legal relationship. The legal subjects are country, the land required applicants and the people who will lose their land. In such a legal relationship, the legal status of the tripartite parties is unequal. The unequal status will certainly lead to unequal treatment which led to jeopardize the interests of the weak. How to meet the needs of the public welfare undertakings while at the same time protect the rights and interests of the weak, it has to become a land expropriation issue of concern.Since the amendment to the constitution in 2004, the issue of land expropriation becomes the focus of attention of the public, particularly scholars. With a wide range of prompt solution endless contradictions and disputes, different scholars on different perspectives have different views on the same issue - how to improve our land expropriation system to protect the rights and interests which the farmers should have. I based on the same goal, have done a short distance contact with the farmers to carry on an investigation by the questionnaire survey form to the partial farmers. And I make every effort to discover the farmers' true attitude and ideas so that I make some immature opinions for everybody to discuss.This article focuses on four aspects which involve the farmers' vital interests directly. The cause of compensation disputes, farmers' right to know about land expropriation, farmers' participant right, and dispute settlement methods. It is divided into three major parts: the first part is the investigation outline, introducing the cause, the goal, the scope and the methods of this investigation. Make readers clearly to understand the writing background and the purpose systematically. Second part is the data analysis of the issues. This part focus on analyzing the survey data which highlights contradictions in the process of land expropriation - compensation disputes. This section reflects the flaws and shortcomings in China's land expropriation procedures. This will be conducive to improve the further land expropriation system, and build a harmonious socialist new countryside where adhere to the people-centered. The third part is the conclusion of this paper, which the objective statistics collected rationally analyzed. In this part I make some immature proposals from three aspects to improve China's land expropriation system. First, resettle compensation disputes reasonably, including increasing land compensation standards, distributing the compensation costs rationally and expanding the scope of compensation. Second, safeguard the farmers' participant right and the right to know. The investigation aims to show the true thinking of the farmers in mind, in order to make a contribution to our land expropriation system.
