On The Implementation System Of WTO Dispute Settlement Mechanism And The Countermeasures Of China

The WTO Dispute Settlement Mechanism plays a significant role in the settlement of trade dispute between WTO members and the protection of the healthy operation of the WTO multilateral trade system. As the last procedure of the WTO Dispute Settlement Mechanism, the implementation system is evidently important. However, the implementation system has manifested many problems and defects during its practice of the WTO dispute settlement, which caused WTO members' reconsideration of the system. On the other hand, China, as one of the WTO members, its trade disputes with other members of the WTO showed the growing tendency, and the China has felt the great challenge brought by the implementation system. How to cope with the challenge becomes an existing problem. Hence, as for China, the research of the implementation system of WTO Dispute Settlement Mechanism not only plays an important significance in theory but also in practice.This paper consists of four parts. As a start, part one gives us a general introduction of WTO Dispute Settlement Mechanism in general, and then states the implementation system of WTO Dispute Settlement Mechanism in detail from retrospection the history of GATT implementation system . Besides, part one also does the brief comment on the advancement of WTO Dispute Settlement Mechanism comparing to the GATT's.Based on the current provisions of implementation system of WTO Dispute Settlement Mechanism and the practice of WTO dispute settlement,part two focuses on the analysis of defects of the implementation system.Following the analysis of part two as well as considering the proposals made by WTO members and scholars, part three makes several proposals on the reform of the implementation system of WTO dispute settlement.In the consideration of foreign trade development of China and the China's involvement of the WTO dispute settlements since it's acceding to WTO, part four analyses the difficulties which the China is facing during it's utilization of the implementation system of WTO dispute settlement mechanism ,and provides several proposals for China further on the implementation.
