A Study On Socialization Of China Minor Guardianship System

The minor guardianship system is a very important legal regime. The system is set up to protect the personal rights, property rights and some other rights for the minor without civil capacity or those with limited civil capacity, guarantee the minor to grow up healthily and maintain the normal social order. Minor guardianship system was set up very late in China. It is true that the system has formed some content, but there are still a lot of legislative flaws in its guiding principle and specific system requirements for many reasons. As the society has changed a lot and the relationship of marriage, family and guardianship has become more complex, it has been clearly demonstrated that the minor guardianship system has greatly fell behind the objective needs for social development in China.Based on the protection of the minor's rights, the writer analyzes the content and shortcomings of the present minor guardianship system in China. And then the writer analyzes the relationship between the guardian and the socialization of the minor, makes a conclusion about the sociological significance of protecting the minor, and proves that the government has the unshirkable responsibility in protecting the minor. Finally, the writer predicts the future of the system on reviewing the history of the system, and at the same time points out the trend for the minor guardianship system is the socialization of the protection of the minor. So the writer put forwards some suggestions for the development of the system on the basis of the analysis about the present system in China and some experience from the foreign countries.
