Research On The Issue Of The Registration Disposal Of The Real Estate Property Rights

Property change in terms of reason may be divided into two types: basis on the legal act and non-legal act. Property change based on non-legal act applies the rule of the registration disposal regulated in the Article 31 of the Property Law. In order to avoid to appear"breaking point of the rights", in case those cases given in article 28 to 30 happens, the right person may acquire the property right without registration. The right in nature still belongs to the property right. So as to the credibility of the registration and keeping the business safety, the right person may not challenge any third person with good faith before dealing with the real estate registration. And the disposal act of the new right person shall not have the effect of the real estate property change, but the contract between new right person and alienee is still effective.Through the analysis on articles 28 to 31 of the Property Law , the author believes that it is necessary to make a few adjustments for the status of applying the registration disposal and make further definitude about the beginning time of the property .
