According to the article 33 of the constitution in china, "equality right "is one of the basic rights which should be protected by the constitution. As the legal citizen of the nation, the peasantry should also have the right. Although Chinese economic has developed rapidly after reformation, the difference between village and city is increasing. Among these differences the most obvious problem is the "three rurals". The core of this problem is the problems about peasantry. The equality right of the peasantry has not been respected and protected yet. The lack of the social equality right of the peasantry is one of the most important aspects.This kind of lack is mainly exited in employment right, education right and social security. The mainly reasons which caused this problem are the following ones: negative influence of the traditional opinions about social estate, binary system of the social framework leading to the inequality, the discriminatorily regulation in the law, the problems of the peasantry being themselves, the lack of supervision in reality, and ect.The" 11th Five-Year plan" put forward the layout of "To bring moderate prosperity to China in a well-rounded way, building new socialist rural areas" , therefore, we should solve the problem of "three rurals" . The key is to solve the problems about peasantry. In order to reach the ambition, we should affirm the legal status of the peasantry equality, prescribe the special rights of the peasantry, consummate the security measures of the equality right of the peasantry. Through these measurements, we can ensure the social equality right of the peasantry in juristic way.
