Research On System Of The Right To The Use Of Rural House Site

The legislative system of RURHS(the right to the use of rural hours site)plays an important role in the survival and development of peasants and the whole rural area's social stable order. There raise many new problems in using about the rural property in land with the development of the social economy nowadays, and it is conflicted with the need of the social development. These problems are difficult to be solved by the law and administration adjustment now.To solve these existed problems of the legislative system of RURHS and constitute the new legislative system of RURHS on this basis, it is the purpose of this article. Firstly, this article analyzes, investigates and researches the history, legislation status and the main problems and conflicts in practice. There problems are in the rural property's acquisition, the management legislation, using, transfering, extinction etc. Those problems are both caused by the reasons relating with history, law system and so on. This paper comments the base principle of building the new legislative system of RURHS: protecting the area, reasonably using the rural area, efficiently using rural land, and protecting the rights of peasants. On this basis,it points out the constitution of the legistative system of RURHS in acquisition, transfer, content, extinction in details.
