A Study Of Basic Categories Of Chinese Constitution Study

The issue of the basic categories of Chinese Constitution Study was proposed followed by the study of new system of Chinese Constitution Study. The traditional system of Chinese Constitution Study was built on the basic of copying the study system of Soviet Union, has been separated from the practice of Chinese constitutionalism. The new system of Chinese Constitution Study needs to be established. The enacting of Chinese Constitution of 1982 became the turning point of the development of Chinese Constitution Study. From then on, many scholars began to work at the issue of constructing the new system of Chinese Constitution Study. The establishment of the basic categories of Chinese Constitution Study is the symbol of consummating system of categories of Chinese Constitution Study, which is very important for the building of the system of Chinese Constitution Study. But, the scholars have not achieved unification.This article thought that the basic categories of Chinese Constitution Study should be include for categories, which were the rights of citizens, the powers of State, the constitution norms and constitution implementation. There are three parts in this article.The first part of the article is mainly about the introduction of the main points of the study objectives and basic categories of Chinese Constitution Study. The main viewpoints are the theory of corresponding categories, the theory of single categories and the theory of synthetical categories. The basic categories must reflect the idea of the objectives of Chinese Constitution Study, and also must keep stabilization in a long time.The second part is the most important part. It's about the commutation of the basic categories of Chinese Constitution Study. The rights of citizens, the powers of State, the constitution norms, constitution implementation and the relationship between them will be explained in detail. The third part is mainly about the study value of the basic categories of Chinese Constitution study. The basic categories will provide the theory support for the practice of constitutionalism. It will promote the development of the education of constitution study. And, it also reflected the tendency and direction of the constitution study.
