An Analysis On News Impinging Privacy

Privacy, as one of the rights of a person, is increasingly recognized by people. While news freedom, as a basic freedom protected by the constitution, in many cases, infringes people's privacy. In the modern civilized society, people's privacy and news freedom are both necessary and important. One the one hand, people's privacy needs to be protected by the law. On the other hand, the social functions of the media of news need to be strengthened. As they are both the basic rights of people, how should the conflict between news freedom and the protection of privacy be handled? With the fast development of information technology and the improvement of mass media, the conflict between news freedom and protection of privacy is getting more prominent. Therefore, we have to solve the questions of how to balance the smooth spreading of news and the assurance of security of people's privacy. The right of privacy is one of an individual's personal right, with which, he could freely deal with his personal information which doesn't have to do with public interest. While news freedom, as a basic political right protected by the constitution, is based on the public interest. In modern society, people, on the one hand, want to get more information to satisfy their spiritual needs, on the other hand, are unwilling to expose their private information to others. To meet people's needs, mass media have to go deep into people's life. Therefore, the conflict is inevitable. The thesis, centered on the discussion of news freedom impinging privacy protection, aims to improve privacy protection. The thesis is composed of four parts. In the first part, one case about the news infringing privacy is cited . The second part makes a detailed analysis on the nature of privacy, starting from the case. The third part mainly studies the questions connected to the phenomenon of privacy being impinged by news. The author makes a detailed analysis on the relationship between news freedom and the right of privacy from the point of view of the reasons of conflict, the components and ways of responsibility in a infringement of privacy and some principles for excluding the possibility of privacy infringement. In the last part, the author tries to enhance the protection of privacy from the aspects of law and news media.
