Legal Solution On Utilizing Foreign Investment In Western Region Of China

Utilizing foreign investment to develop economy is an important method applied by each and every country of the world , and it is also an important experience once adopted by the eastern region of China to develop its economy .At present , the development of western region of China is facing fund shortage and other difficulties, however, utilizing foreign investment is one of the effective means to expand ways of financing and to accelerate development of economy in western region .This thesis introduced the development course and development tendency of foreign investment in past 30 years, and through analysis of utilizing status of foreign investment in western region of China, the thesis held the opinion that the utilizing status of foreign investment in western region of China lags behind the eastern region of China in the aspects of the investment scale, investment number, industry structure ,investment method and others, and the thesis disclosed existent problems and its limitations of legal system further with regard to foreign investment utilization status in western region of China.The thesis considers rule by law is an important measure to ensure investment safety and constancy of utilizing foreign investment and in the process of utilizing foreign investment, the existent problems which the western region is facing should be solved by the means of law. Therefore, the writer made suggestions from the point of view of enact an uniform Foreign Investment Law of Western Region, and to expect to improve investment environment and solve investment difficulties in western region of China.This thesis consists of four parts, part one introduces the development path and development tendency of foreign investment in western region of China, part one also analyses current status of foreign investment in western region and states the status and function of rule by law in utilizing foreign investment in western region.According to the above analysis, part two points out problems of foreign investment utilization in western region of China, part three discusses current states of legal system of foreign investment in western region and limitations of its legal system.Based on the above analysis and discussion, part four provides countermeasures in utilizing foreign investment in western region of China from the aspect view of legislation. Part four states the necessity of enacting an uniformed Foreign Investment Law of Western Region, which include the suggestions on legislation orientation and its main content.
