| Neighboring rights are the product of the improvement and development of human's communicating technologies. The intension and extension of the neighboring rights will also be changed and developed as the development of human's communicating technologies. In nowadays, as the continuous development and popularization of computer applied technologies, many people use computer as a tool for studying, researching and communicating and the Internet has become an important port in people's daily life and work. Internet not only changes the method of transmitting works, but also accelerates the speed and expands the field of transmitting works. The owners of neighboring rights are the most important transmitters of works, the bridge of the owners of copyrights and readers, the chief power in culture market; therefore, their significance can not be neglected. The trend of the global economic integration makes the trade of copyrights more and more important., therefore, to study neighboring rights is important and valuable for prospering culture market, transmitting knowledge, complying with the international standard, connecting with the international market and effectively exercising our rights in WTO.The thesis consists of four sections. The first section narrates the origin and the meaning of the term of neighboring rights and makes systematic analysis and discussion of the basic theory of neighboring rights. The second section discusses the composition of neighboring rights and makes concrete analysis of the subjects, objects and contents of neighboring rights in Internet. The subjects and objects in some new neighboring rights in Internet transmission is specially analyzed. The third section discusses the exercising and limitation of neighboring rights in Internet transmission. It mainly narrates some concrete ways of exercising and limiting of neighboring rights. The last section analyzes the liabilities on the infringement and relief of different net subjects. |
