| The crimes by minors are worldwide severe social problems, and the situation of which are also very severe in China. The criminal policy of"Temper Justice with Mercy"is a radical one in China .One of the important aspects of carrying out this policy in managing crimes by minors is regarding mitigation as an ultimate principal. At present, although the criminal system of crimes by minors represents mitigation in some degree, a few problems and limitations exist. In this paper, the author discusses about how to improve the criminal system of crimes by minors, and put forward that the punishment principals should be definitely stipulated, and punishment sorts, the penalty measuring system, the non-penalty disposition methods also have room to consummate. And all of these viewpoints are put forwarded to better prevent appearance of crimes by minors and cure minority criminals. |
