Discussion On The Effect Of Judgment Quality And Efficiency Evaluation System

As is stipulated in the Compendium of the"Second Five-Year"Reform of People's Court, it is rudimental task to reform and improve the management system of judicial judgment and judicial government affairs, establish a coordinative mechanism between the case judgment, judgment management, judicial government affairs management and judicial personnel management, to improve the judgment quality and efficiency, and build up a scientific and unified evaluation system of judgment quality and efficiency. The judgment quality and efficiency are the most essential components of a court's judgment performance, and their management is an important content of judgment management. In recent years, in order to meet the requirements for developing the judicial judgment, the concept of performance evaluation has been introduced tentatively from the public management domain by a number of courts in China, and that's how the judgment quality and efficiency evaluation system came into being. What's the judgment quality and efficiency evaluation system? What're the effects of such a system? Does it really facilitates the improvement of judgment quality and efficiency so as to realize the value goal of justice and efficiency? In this paper, the author, setting out from the angle of system reform of judgment management, has laid out his argument by positioning the effects of the judgment quality and efficiency evaluation system of the courts in Jiangsu Province. First of all, the author sets forth from the historical development of the judgment management in China to the introduction of the judgment quality and efficiency evaluation system, then introduces the basic contents of the system in detail, which is followed by a description of the purpose for setting up such a system; after that, the author demonstrates the actual effects brought by this system by presenting practical cases, and finally, he comes to the conclusion that such an evaluation system will definitely exert positive facilitating influences on the improvement of judgment quality and efficiency. However, to realize the goal of justice and efficiency, the two-side coordination between the reform of macro judicial system and the intra-court judgment management system is the essential approach. On this basis, the author positions the effect of the judgment quality and efficiency evaluation system onto the layer of the references for management's decision making.
