The Studying Of Usucaption System

Usucaption is an old system in the traditional civil law. In Roman Law it was formulated as one kind of prescription system, and was passed on in civil code of different counties. At present, it still has some social values. This article analyses the constitution requisites and applicable targets of usucaption, then the relationship between usucaption and other civil law system. What's more, it also dissects the history evolution and argument concerning this system in our country. At the same time, it also analyses how it is provided in the suggestion drafts of jurisprudent and legislation statue. In the writer's opinion, it is really necessary to formulate usucaption in civil code of our country. Usucaption and extinctive prescription should be put in the volume of general principles with the legislative style of united and coexisted.
