| Establishing and improving the official documents of pre-review system , Strengthening government oversight of the abstract, for the prevention of unlawful administrative acts, maintaining the government's image, promoting administration according to law and building a law-based government is of great significance.In recent years, local governments at all levels started to attach importance to pre-review of official documents, and has made some achievements. However, generally speaking, the work of legal supervision of the local government is a weak link. Widespread review of the official documents arbitrariness.This article must be done by the current official documents pre-examination of the lack of standards, and procedures, such as the institutionalization of analysis, research, and make efforts to resolve the issue of administrative supervision virtual home, but also conducive to the solution to use the opportunity to expand executive powers and corporate interests, the administrative rules and regulations "generalization."Summarizing from the pre-review system of non-legislative official documents, the author expatiate the present condition of this system and analyze the existent problems. It also stressed that China's existing normative documents pre-review system significance, and also put forward measures to solve the problem. Using the theories of public management, public policy, administrative ethics, and other related knowledge, this thesis analyses the specific existed issues in a certain way.At present, the system has four aspects of the pre-review system of non-legislative official documents. First, the executive authorities do not have a strong sense of responsibility, lacking of the spirit of being responsible to the public. Executive actual aim is to expand its powers, to meet their own interests. Second, the normative documents establish procedures there is no uniform requirement. The contents of the documents can not be an offence to provide effective constraints. Third, it is heavy workload of the pre-review system of non-legislative official documents, and the situation is complicated, it is no uniform standard of review. Fourth, it is not unlawful to establish a sound mechanism for accountability.To address the above issues, with the status of Structure of the administration, proposed four measures:First, established the non-legislative front the normative document review system, must to improve the regulatory documents pre-review system awareness of the importance of negative factors ideologically. Second, is to improve the development process. Establishing procedures to scientific, standardized, in order to save the abstract supervision of the administrative costs.Third, we need to standardize pre-review process. Changes in the examination and supervision of the phenomenon is not in place. Fourth, we should establish supervision and inspection mechanisms.Departments should give full play to the supervisory role of the legal system to avoid the continued use of outdated documents, supervision of the process of solving the problems found. |
