Research On Membership's Right Of Owners In Residence Community

With the reform and opening-tip to the outside world policy being implemented deeply, the cities in china develop rapidly followed by crisis of expanded population and shortage of residence . To resolve this problem effectively ,more and more three-dimensional buildings have been built ,which give rise to the phenomenon that more and more people live in the same district and more and more conflicts between residents take place .In order to handle rights and duties enjoyed by residents in community ,membership's right has become a heated topic in theory and practice.Membership's right of owner has been analysed systematically in this thesis ,so does the membership's right independence in law .Firstly, the thesis begins with membership's right which is the superior concept of membership's right of owner .Secondly ,how to perform the membership's right having been researched by comparing. Comprehensive conclusion about membership's right of owner has been drawn in theory and practice. Concretely speaking, the membership's right of owner has been researched in the following five sections:First chapter is about the basic theory in membership's right .In this section , the author focuses on three aspects : concept,character and element of membership's right. Second chapter has talked about the basic theory on membership's right of owner which is the most important content in this thesis . Third chapter focuses on basic theory of management organization and regulation of community which is the premise to perform membership's right of owner. The author researches on form,character of management organization and necessity of establishing management organization and analyse the character and content of management regulation. In fourth chapter ,the mechanism of how to perform membership's right has been analysed by comparing .The author has evaluated the advantage and disadvantage of various mechanism and put forward some legislative suggestion. The fifth chapter is the conclusion and summary of the thesis.
