| Entering the 21st century, the Internet industry has undergone an unprecedented development, and also shows deficiencies in the legal system, regarding the field of network. Particularly, the disputes frequently occur in virtual property of network games. Virtual property of network games becomes a focus that is seen and discussed. But we have not a clear analysis in theory, and also have not good methods in practice. So it becomes a difficult problem.I have read a lot of books and articles, and got some useful materials. According to those, I write the article in order to make the theory clearer. The article is divided into four parts.The first part discusses that the definition and the characte of virtual property of network games . We get a conclusion that the character of virtual property includes: intangible, time limit, technicality, value. By comparing, we want to get the conclusion that if virtual property is property.The second part researches the attribution of virtual property of network games. I may discuss the three popular characters: ownership, creditor's rights, intellectual property rights. Which character that is? And I think visual property has two characters: eminent domain rights and request rights.The third part focuses on the legal relation of virtual property of network games. Firstly, we analyse the rights and duty between players and game businessmen, and the legal relationship between players and the third men. Secondly, we summarize the kind of virtual property of network games. At last, we analyse how to distribute the responsibility.The fourth one concentrates on building the legal system. We introduce related regulations in other countries. Basing real situation, we give some opinions, for examples, we should put some regulations into use. Only in this way, virtual property of network games can be protected, as the same as the property.There is a new object, there is dispute. And we can find that there is some insufficient regulations. To our happiness, our legal system is makes progress, which is my writing aim. |
