A Study On Legal Attributes Of Virtual Properties

With the rapid development of the net game, net space has resulted in some problems, which is vacant in law; virtual property is one of them. Virtual property has the common attributes of the legal property. It also has some special attributes, such as non-agelong existence and continuation and non-consumptive use. Therefore, a great deal of disputes and their legal settlement being the focus that all circles discuss actively. Consequently, researching virtual property not only can propel the traditional civil law, creditor's right and property right of knowledge, but also has practical meaning in justice to deal with civil and criminal dissension.Based on literature, cases and practice, this research takes advantage on many approaches, such as concert analysis, reasoning, deduction and conclusion and etc in order to give a clear research result. This paper divided in five parts. Firstly, discuss the present research conditions of this topic. Secondly, analyze the legal attribute of virtual property in detail in order to know about the basic problems of virtual property. Thirdly, this part is the key of whole paper. We talk about the different viewpoint in academic field, and then contrast them, what's more, the author give the research result. Fourthly, we provide some policies to protect virtual property. Fifthly, we conclude the whole research and give some explanations.
