Legal Study On Environmental Measures And Trade Measures Under Multilateral Trading System

Nowadays, the whole world is in face of two tendencies. The first one is to implement the liberalization of trade in order to improve the increase of economy and enhance the comprehensive national strength. The second one is to strengthen the extent of environmental protection and solve environmental problems by trade measures. So the environmental protection and free trade are the common aims of the international community. And how to solve the relationship between trade development and environmental protection correctly becomes the target of the way of sustainable development. The continuous development of free trade makes the environmental problems deeply come into the multilateral trading system. And with the development of environmental problem, the procedure of realizing the free trade shows more complicated.With the development of environmental problems, the multilateral trading system and its members should think that how to prevent the trade barriers from using Trade Related Environmental Measures and Environment Related Trade Measures for the aims of environmental protection. The using of Trade Related Environmental Measures and Environment Related Trade Measures should follow some principles and conditions so as to reach the aim neither damaging environmental nor breaking the free trade.The key point and difficulty to harmonize the relationship between environmental and trade is the imbalance of the members, especially, the differences between developed countries and developing countries. So, the nowadays multilateral trading system must think that how to solve the conflicts between the developed countries and developing countries and how to reach the aim of development together. The relationship between trade and environment is watched by many world organizations. But, the standpoints, benefits and viewpoints of every world organization cannot be consistent entirely. On this problem, there are a lot of different strategies and proposals.On the basis of said considerations, this thesis will analyze and research the relationship between environmental measures and trade measures from six aspects in order to find out the way to solve this problem. In the first chapter, the author looks back and analyzes the concern of environment and trade by multilateral trading system. The chapter two introduces the environmental measures and trade measures under multilateral trading system. This chapter will establish a foundation to the followed chapter. The chapter three represents the details of environmental measures and trade measures from the definitions, characteristics and essential of these two measures. The chapter four shows the harmony between trade measures and environmental standards for the example of EU and hope that we will find out the solutions of multilateral trading system in this problem. The chapter five introduces the relationship and harmony of environmental measures and anti-dumping measures. And chapter six the author bring forward some suggestions and solutions to solve the problem of environment and trade. In this chapter, the relative things on environment and trade of china will be introduced too.
