Study On International Legal Issues Of Space Operations

Along with the development of space technology and information technology, space operations will become one important operational style in the future war. Although it is one kind of new style, there aren't no laws to control it. International law in existence has the restriction to it, including charter of the United Nations,outer space law,law of armed conflicts. Because the existing international law falls behind by far the development of space operational technology, and there are many flaws in legal completeness,pertinency,adaptability and certainty, the implementation and the development of space operations has biggish legal room. At the same time, because of the influence from international political situation,development of military benefit and national security, it is with difficulty to form international legal system to limit outer space militarization completely, in the situation of different balancing of national benefit and appealing to perfecting outer space legal system. The lag and absence of international law will cause lots of legal issues and it is inevitably request to deal with them in the future space operations.It more and more becomes an important characteristic in the modern war to implement legal struggle with the coordination of military actions. The non-completeness of international law> high technical nature of military action and particularity of campaign domain make legal utilization and struggle more complex and intense. Viewing the future, it will certainly to have the tendency: paying great attention to the domestic legislation to make up the insufficiency of international law; paying great attention to observing the international law to obtain the leading power of legal struggle; paying great attention to soft operational method to avoid the humanitarianism disaster; paying great attention to using the law neatly to strive for the biggest military benefit.
