Study On The Deposit System

With the reforming and opening, the economy of our country makes a big progress. But how to make sure transactions are safe is turn more difficult. So many people used to make deposit contract for security . the law has some Legislations on deposit system. For example, article 89 of《General Rules of Civil Law》. Then other Legislations and Judicial interpretation of the Supreme People's Court has some articles of deposit. Overall, they are so simply that some important issues are not clear or detailed enough. In addition, the existing relevant provisions are also not reasonable enough. In that condition, As one of the legal systems, the deposit system has become more and more controversial in theoretical circles and judicial practice. So this paper studies on the base of deposit system first. Focus on the specific conditions of deposit system in the application, the Relations between deposit and Responsibility for breach of contract obligations in application .Then, Propose legislative and judicial recommendations. Hope it good for making the deposit system become perfect, and tell people how to apply the deposit system accurately.
