The Legislation Study For Law System Of Unemployment Insurance

Unemployment is an inevitable phenomenon under the market economy, and inevitable result of the modern market economy. But, its existence influnces losing the source of income and threatens the right of human existence ; to a country, unemployment is one of the factors that cause social unrest and state instability. Unemployment has already become a severe problem of a country and a society. As an indirect tool, unemployment insurance can be applied to prevent the disastrous harm which unemployment brings to individual, and can also be adopted to create new employment opportunities. Juristically speaking, the legalization of unemployment insurance system is of great importance. It is an essential means to ensure that the unemployed are protected.Unemployment insurance system is a subsystem of social insurance which is the most important component of social security.Therefore,establishing and perfecting the legalization of unemployment insurance system is the important protection of social stability and country security.This thesis attempts to study the bisic theory of unemployment insurance system , and then put in order the basic structure and content of unemployment insurance legal system . It finds out defects and problems of our unemployment insurance system through researching and discussing on legislation process and current situation of overseas unemployment insurance system, and analysing our country current legalization situation of unemployment insurance system, in order to study on legislation. We can use the experinces and ideas of other countries for reference to put forward perfecting our country present unemployment insurance system, and structure and content of "The Regulations Of Unemployment Insurance", legislation ideas on drawing up" Unemployment Insurance Law" and "Reemployment Law".It is hoped that this thesis can generate some ideas to perfect our unemployment insurance legislation.On legislation, "Unemployment Insurance Law" and "Reemployment Law"can realize aim and function on ensuring people's basic lives and promoting reemployment.According to law,Pefecting on legislation.
