The Research On The Improvement Of The Legal System Of The Use Right Of Assigned Land

The legal system of the use right of assigned land was an exclusive way of state-owned land supplying in the period of planned economy in China. It coexists with the system of selling land-using right to form the double track systems of using of state-owned land, after the reform of state-owned land system. However, the legal system of the use right of assigned land was the product of the planned economy system, though it has been further regulated in the process of the state-owned land system reform, since there are many other factors involved, the implement effect of the present legal system of the use right of assigned land is far from satisfaction. The disadvantages are quite obvious in carrying out this system. This thesis puts forward a corresponding solution on the basis of these disadvantages'analysis.This thesis demonstrates the above idea in three parts. In the first part, it introduces briefly the current regulations on the legal system of the use right of assigned land, and analyzes its legal characteristics and theoretic basis as well, to lay the research foundation for further system analyzing.In the second part, it reviews the history origin and development of the legal system of the use right of assigned land and analyzes its disadvantages. It presents some details of this system in history and makes some comments on the drawbacks in this system's operation, laying emphasis on analyzing reasons that lead to these drawbacks.In the third part, it puts forward some specific measures on how to construct a perfect legal system of the use right of assigned land in China. It suggests some legal principles that we should follow in setting up the perfect system after introducing the relevant land system in some foreign countries and local regions. A solution is come up with at the end of this thesis on the basis of analysis of factors that lead to the drawbacks of the system mentioned above, and some corresponding countermeasures about how to improve the system scientifically are also discussed.
