On The Right Of Privacy Of Medical Behavior

With the development of the market economy , progressing in society and the improving citizen conscious of ruling by law ,the issue to protect the right of privacy was emphasized by us more and more often. As one of personality right , the right of privacy is a basic civil right. The level of the right of privacy by law marked the civilization of society. Since the end of 19th century, the right of privacy has been establishing in the international society step by step. The conception THE RIGHT OF PRIVACY produced in America at first, and now the protection of the right of privacy is the most developed. To say relatively, the act of protection on this way in our country is rather slow, pending further establishing legal articles. For the lack of current laws protections, the victims are usually in an awkward position.The medical profession is a special industry and the right of privacy involved frequently conflicted with other rights. So , the problem of it in medical profession has become more and more complicated. With the developing of science and technology at full speed and the exceeding progress in medical field ,the right of privacy of medical behavior became more and more projecting. Research on the issue of the right of privacy in our country have conducted a related exploration and has achieved many results. Under the condition of the deep theoretical study in the right of privacy and the new change of China's legislative and amendments and perfection in practice, the formal establishment of the right of privacy in medical profession will be benefit and the relations between doctors and patients will be relaxed day by day.This paper is divided into 3 parts, the Introduction part, the Main part and the Conclusion part.The Introduction part is a brief description of the status and the significance of researching the right of privacy of medical behavior.The Main part consists of four chapters. Since the right of privacy is one of rights at first, Chapter I is from right up on. The author explained the meaning of right and then expounded the essence of it . Chapter II discussed the basic theory of privacy : the meanning and the developing in today's world . Chapter III is right of privacy of medical behavior .In this chapter, the author introduced the nature of medical behavior at first, then analyzed the conception of the patients' right of privacy, self-characteristic legal features and principles conflicted with other rights. And finally, set forth the constitution of the patients' right of privacy and the legal duty. Chapter IV analyzed the present situation of it and the existed deficiency, then , put forward 3 ideas on the perfection of the right of privacy of medical behavior.In the Conclusion part, the author stresses the academic research inadequate on the right of privacy of medical behavior and, talks about that administrative and legislative emphasis has to be raised further. The author hopes that through this paper the theory and practice of the right of privacy of medical behavior can arouse the attention of more and more people.
