Research On The People's Supervisor System

The people's supervisor system is an important reform in China's procuratorial organ. It is means that the procuratorial organ places themselves under the supervision of the masses consciously. It has been focused everyone's attention since it had made experiment from 2003'8. The experimental works have made much progress in improving quality of case, in converting the style of enforcing the law.Of course, there are many defects such as system's design etc. in preliminary stage of system. Some questions couldn't solve by procuratorial organ but by legislature. It means that make clear the supervisor's qualification, selection, protection, range and procedure of supervision, and the legal effect of opinion. Then sets up the organization that supervises the people's supervisor so as to ensure the operation of system in order.The author explains the concept, the essence, the value and jurisprudential foundation of the people's supervisor system in the first part of the article. There are the content of current rule in second part of the article. There are emphatic analyses of the virtue and defect of the present rule by the research on operation of the system in third part of the paper. The last part is about the developing ponder, which product the complete scheme of the people's supervisor system by referring the overseas successful legislative experience.
