Globalization, especially the emergence of the global market, makes the educational development to appear the new characteristic. Education begins to go on the road of transnational development, appearing the trend of fast development of cooperative school, which becomes the important character in international education exchange. With the deepening of our reform and opening-up policy, China has made a series of policies to encourage educational field to open to the world. Under this background, in the past ten years, the Chinese-foreign cooperative school has developed rapidly; the school body expands progressively; the level of running a school rises gradually; the mode becomes more and more diverse. In November,2001, China joins in WTO, which promotes the Chinese education service into the world, especially impelling the Chinese-foreign cooperative school to speed up the steps. The Chinese-foreign cooperative school has played a vital role in introducing foreign high-quality educational resources, referring the foreign beneficial experience of teaching and management, accelerating the paces of Chinese educational reform, training all kinds of talents needed in national economic construction, promoting the international exchange and cooperation of Chinese Education, increasing diversification and selectivity for Chinese educational supply. However, some problems exist in Chinese-foreign cooperative school, such as the level of running a school is on the low side; there are so many cooperative projects, but only a few of them have been examined and approved; we send the so much money to foreign countries, but introduce only a few of foreign educational resources .In order to adapt to the new situation of WTO, fulfill the commitment of our promise, turn the promise into the national legislation, expand education opening to the world further, strengthen the exchange and cooperation with foreign countries, promote the development of educational undertaking, China has made a series of laws and regulations, such as The Regulations for The Chinese-foreign Cooperative School and The Implanting Methods for The Chinese-foreign Cooperative School and so on. But WTO puts forward high requirements to legal system of our educational undertaking. The current legislations regulating the Chinese-foreign cooperative school still have a series of problems. This text discusses these problems under GATS mechanism all the time. It analyses the current legislation situation, from the national background to the international environment. Author summaries all the problems, then put forward measures to improve our related legislations, expecting to enlighten the standardization of Chinese-foreign cooperative school in some extent.
