The Study On Administrative Omission And It's Legal Relief

Cases about administrative omission occour frequently in life. People has not put enough attentions on harmes of administrative omission. There are also many defects about lawsuit relief and national compensation.To resolve the realistic need and theorical disputes, this article studies on administrative omission with compared and real analysed methods. By analysing it,s premise,condition,nature,owership and so on, the article concludes the concept of the administrative omission. And then, this article discusses the burden of persuasion in lawsuit. It points out that the plaintiff should prove something in special lawsuits and there are several different contents in performance judgment. Last,it discusses the national compensation of administrative omission.
