| The pretrial review procedure is a transitional phase in criminal procedure, which links up the public prosecution and judgement. Seeing about the legislation in the world, the pretrial review procedure is such an important process that it can ensure favoring criminal judgement, guarantee optimized judicatory resource, and accord with the request of basic proceeding value. At the same time, the criminal pretrial review procedure in China, has been ignored by legislation, judicature and study all through, and a proper pretrial review procedure has not been constituted up to the present, which is one of the causes why Chinese judgement reform still relapses into puzzle dom. On the basis of researching the criminal pretrial review procedure of other countries, the dissertation detailedly discusses the actuality and abuse of Chinese current pretrial review, and put forward the project to reconstruct criminal pretrial review procedure according to modern criminal procedural concept. |
