Our Country Judicial Interpretation Is Wrong For With Rectifies

My interpretation is based on the legal interpretation of the relevant resolutions of the NPC Standing Committee, the highest judicial organ of the specific legal interpretative generally binding legal document. As an important source of law, it will make up for the legislative work in the rough and stagnant, a certain extent, in the actual work of the judiciary could not resolve the situation as well as to follow the law too difficult to apply the principle of the issue. However, China's judicial interpretation in the process of development with strong local color, there is much room for improvement. The author's own practice, seriously examine our judicial interpretation on the basis of the status quo, focusing on analysis of the existence of judicial interpretation, and from the main content, format and so on. Correction and improve our existing system of judicial interpretation of the proposals, aimed at promoting the reform and development of China's legal interpretation.The writer believes that, from a long-term perspective, China's judicial system should be interpreted and other laws, we have to go along with the rule of law at home and abroad advanced concepts and the development trend of gradually integrate into the international judicial community, in light of current conditions, at the very least must follow the country's current political system, power mechanism and the judicial system. In view of the judicial interpretation of Chinese characteristics will continue to exist for quite a long time and therefore suitable for reforming the current system of judicial interpretation, and properly resolve their irregular, unreasonable and unlawful, it is an important task for promoting China's rule of law.
