Study On The Law Problems Of Emission Administrative Permission System In China

Emission administrative permission system, belonging to the category of environmental administrative permission, insures the normal operation of pollution management by the inspection and supervision for the emission conduct of emission enterprises. Implementation of emission administrative permission system bases on the control for emission gross of pollutants to establish and perfect the systems of enactment, grant, management and supervision about emission permit, thereby to improve environmental quality.Although China implements the system of emission administrative permission in some domain, the effects are not significant. Of these, China mainly performs the system of sewage emission administrative permission, the implementation on the system of atmospheric pollutants emission administrative permission still is in the initial stage, little research is about the system of noise pollutants emission administrative permission. Compared with many developed countries and regions, Chinese emission administrative permission system has bigger gap in law status, management object, system basis, type and content of permit, implementation and guarantee mechanisms, and so on. Many studies focus on environmental administrative permission in China, however, few are on emission administrative permission system. At present, there are lack of perfect management systems and correlative laws and regulations for pollutants emissions, and scientific emission standards and management systems in China, these lead to a slow development in reformation and study on the system of emission administrative permission. Thus, China needs to establish a perfect system of emission administrative permission.This paper adopts the studying methods of history contrast analysis and comparison analysis, and comprehensively utilizes the basic theories of nomology, environment law, administration law, legislation law to analyze the theory and practice of emission administrative permission system, unveil its realism and shortage, and discuss its perfecting pathway. This paper thorough analyzes the relation of emission administrative permission system and correlative systems, and its function and implementation, meantime, makes a theory expatiation on the system vicissitude, regulations of correlative laws, implementing institution and significance of emission administrative permission system in China. This paper gives emphasis to illustrate the law problem, cause of formation, and mostly abuse of existence of emission administrative permission system, such as its constitution basis lacking system, criterion documents conflicting each other, selections of managing pattern and controlling standard lacking science and forecast, theory cognition and system establishment being distinct defect, confined range of mainbody undertaking legal obligation, imperfect mechanisms in information open and public participation, lacking definitely regulations on the repeal and recall of emission administrative permit. By the analysis on the emission permission system of developed countries and regions, the author indicates the countermeasures of perfecting Chinese emission administrative permission system: unifying the legislation of emission administrative permission system, pinpointing the basic principle, newly establishing the control standard of emission, taking the measure of managing emission administrative permit, perfecting the type, content, legal obligations and regulations of emission administrative permit, and entirely fulfilling the systems of information open and public participation...
