Study On The Crime Of Infringement Of Copyright

From its emerging day ,the copyright system has had great impulse on the development of literature and arts. Nowadays, during the advancemenent proce toward knowledge economy age, the copyright system's status in the law systems keeps rising. At present , China has established the relatively complete system of copyright protection , but the research on the criminal protection final remedy measure for copyright ,is still comparatively lack . From the point view of criminal jursiprudence ,the thesis tries to make a deeply study on the criminal of infringe author's right , integrated with author's right. The paper includes six parts apart from introduction and ending.The first part:Genereral introduction of the crime of infringement of copyright.At first review of the legislation evolution of the crime of infringement of copyright between China and foreign countries, then analyse the crime's characterstic at present. Moreover ,the author disscuss criminal law's legislative value-oriention, in order to direct the legislation of China.The second part:The concept and composing elements of the crime of infringement of copyright.The author make an analysis of the concept,the subject,subjective,object elements and object of the crime of infringement of copyright.The third part :The recognition of the crime of infringement of copyright.This part focus on recognizing the crime or not ,distinction between this crime and the relevent crimes ,patterns of joint offense and quality of crime.The fourth part :Criminal resonsiblity of the crime of infringement of copyright.This part concerns about application of penalty of infringement of copyright in China. The fifth part:Comparison on the legislation of the crime of infringement of copyright.This part summarize legislative general situation in the world and make a comparison and research between China and abroad,from five aspects.The sixth part: The legislative improvement of the crime of infringement of copyright.The author demonstrate the flaw on the crime of infringment of copyright of China and the idea on perfecting law.
