Research On The Choice Of Law Protection Model Of National Folk Literature And Art Expression In Our Country

As the coming age of knowledge economy, more and more countries begin to pay attention to the protection of the folk literature and art expression. From the 20c50s, the international organizations, regional economy organizations and some developing countries start to enact special law to protect the folk literature and art expression, and most of them have adopt the intellectual property protect model . In our country, the government has taken several steps to protect the folk literature and art expression. However, nowadays there is no correlative law in our country . There are many reasons of lack of the special law, one of them is the choice of the law protection model.This article takes both positive research method and comparative research method to analyze the present protection situation all over the world, especially comparing the law protection model of different countries. In addition, this article analyzes the existing law protection and its limitation in our country. For the sake of choosing the appropriate law protection model, the article compares the advantages and the disadvantages of three different law protection models and their existing social condition .Finally, we get the conclusion that there should be a special law in our country to protect the folk literature and art expression. On the base of the conclusion, the writer put forward some advice of the special law.This artical concludes four parts. Chapter 1 introduces the general situation of the folk literature and art expression. Chapter 2 analyzes and compares the diffierent protect situation in different countries. Chapter 3 points out that the intellectual property model in our country isn't appropriate. Chapter 4 gets the conclusion that there should be a special law in our country to protect the folk literature and art expression.
