On Northwest Mining Environmental Legal Issues

Resources and environment are the core of sustainable development of international community in the 21th century. They are also the important factors impacting on the economic and social coordinated development of China's northwestern region .Rich mineral resources in northwest region have contributed undeniable function to the national economy. However, the development of mineral resources is a two-edged sword. Mining enterprises Bring the most serious negative effects to the environment while they enhances the economy. The ecological deterioration of the mines in the region has seriously affected the ecosystem of the region and the ecological security of the whole nation. This paper, adopting the empirical methods and the legal-Economics methods, will analyze the economic value of mineral resources in the northwestern region. And then closely centering on the relationship between the environment and the economy, I will analyze its ideology source and system source. As to the environmental awareness, I put on "Environment Productivity " idea centering the principle "Prevention First" of the environmental law; As to the system source, I aim at improving the system of ownership of mineral resources. Then on the base of the prerequisite, I suggest to building economic environmental legal system.Economic environmental systems are the institutionalized economic means. According to the paper, on the base of Western economist Pigou's theory and Machakos' theory, I will explain the meaning ,the framework and the significance of the environment tax system ,the mine land rehabilitation bond and the transaction tax system. I also propose to strengthen mining environmental law execution; fostering a good law-abiding cosmos. And then establish and give full play to the local environmental protection organizations.
