Anti-dumping, as a trade remedy, has been frequently abused throughoutnowadays business applications. Admittedly, it somehow protects the interests ofcorresponding manufacturers from importing countries, but it simultaneously presentstremendous detrimental consequences to importers, users, and customers.Accordingly, numerous states and regions have enacted or implemented regulationsagainst anti-dumping in social practices, thereby defending the principles of publicinterests and reversing the balance prompting the latter's fights. Nonetheless, publicinterests clause is encompassed in anti-dumping legislation. The clause itself, theauthor finds a series of deficiencies and necessity to consummate the principle ofpublic interests and legislation of anti-dumping, considering the efficiency to resolvethe problem and the aim to hasten or at least maintain China's economicdevelopment.This article is comprised with three parts: the first part summarizes the theory'sorigin, basis, characteristics within its evolvement, and the measure factor of theprinciple of public interest, all of which lend the fundamental theoretical backgroundof the article; the second part mainly introduces a variety of representativeorganizations, regions and states in the world, and their legislation and socialpractices with regard to the principle of anti-dumping. With reference to theirvaluable experiences, it should facilitate the establishment and reform of our ownrelated legislation and regulation; the last part including key analysis of this paperargues the rationality and necessity to enact the principle of anti-dumping, and thenfurther analyses the status quo and the insufficiency of the principle. In the finalanalysis, the author proposes her suggestions concerning the improvement of publicinterests act from two aspects, the legislation and its social applications. Moreover,the paper also elaborates to the implementation of public interests cause in empiricalcases.
