| The trend towards humanization administrative law enforcementcalls for a revolution in the ideology of law enforcement and aninnovation in the enforcement system. In administrative law enforcemen阿t, the ideal of human-based enforcement should be emphasized,humanism in the enforcement system should be cultivated, and everyindividual's value and dignity, his existence and life, reality and ideal,destiny and future should be considered thoroughly. It can be said that theway that laws and decrees are executed carries with it peculiar values andmoral criteria. Prevailing ideologically in the administrative execution oflaw should be values and moral judgment based on the respect for everyindividual's basic human rights; the subjectivity of the counterpart andsomeone should be valued, their legal rights and benefits should beprotected, and their human dignity should be particularly respected.Therefore, the study of the humanization of administrative lawenforcement is of great significance.This paper aims to investigate the five aspects of this topic.Chapter One is a survey of the legal grounds concerning thehumanization of administrative law enforcement. It discusses theconnotations of administrative law enforcement and its humanization andoutlines the history of the explorations in administrative law enforcementand its humanization.Chapter Two explores the conflicts and interaction betweenadministrative law enforcement and its humanization. It proposes thathumanization is an essential requirement of government by law and thatharmonious society and the humanization of administrative lawenforcement share the common ground and are related naturally.Chapter Three deals with the dehumanization of administrative lawenforcement and the reasons behind it.Chapter Four focuses on the principles of humanization ofadministrative law enforcement, like the principle of administrative law enforcement and law, the principle of law reservation, the principle ofrespect for human dignity, the principle of confidence protection, etc.Chapter Five gives consideration to the humanization ofadministrative law enforcement. It proposes that the quality of lawexecutors should be uplifted, the employment rules and regulationsshould be enforced to letter, the rules and rerulations of assessment andpunishment should be perfected, the system regarding the learning andtraining of law should be strengthened, and work ethics should beemphasized. It also proposes that humanization of administrative lawenforcement should be given institutional guarantee, and the enforcementduties should be made clear. |
