The Defects Of The Agreement On Subsidies And Countervailing Measures And These Defects' Overcoming

The Agreement on Subsidies and Countervailing Measures(ASCM) of WTO has important function in regulating and adjusting the subsidy problem. However, the WTO is a dynamic system, and the introspecting to the agreement has already caused the concern of numerous scholars currently. Especially, after the Kankun meeting stagnant negotiate progress makes the perfection of ASCM become more urgent.This article analyzes the concrete item and the relevant case in practice. Combining the suggestion of scholars and governments, it aims at the defects of the ASCM, and analyzes its source and actual influence in detail, and puts forward some improvement measures. The whole article is made up of four chapters:Chapter 1: the defects of the ASCM. This chapter analyzes the item of the agreement at first, and points out its harm by combining the relevant cases, as well as the need for clarification and improvement of the agreement.Chapter 2: the perfecting progress and basis of ASCM. This section deals with the perfecting progress and the economic and legal foundation of improving the agreement. Chapter 3: the concrete measures perfecting the ASCM. Based on many times multilateral negotiation and countries' proposal, this chapter introduces various clarification and improvement method of the ASCM.Chapter 4: our measures adopting to the existing defects of the ASCM. Our country is the largest developing country, it has very strong realistic meaning to study how to research and analysis the ASCM in the development country' s position and put forward suggestion in recession.
