Ethical Research On Chinese Contemporary Human Rights

Human rights is a noticebale concept.And human rights itself is one of the most sophisticated and disputed problems in the humane studies fields.Though people attempt to reach a consensus with the human rights concept,there are so many differences between Western and China in culture styles,history tradition,politics idea and economy interests,and the reality is far from the ideal ,tradion conflicts with reform in each nationality of each country.All these made people have different requirement in their needs,nature,dignity,characator and humanity.So there are different kinds of definition to human rights. Some people think it's a political right ,but others think a law right or moral right,or even summation of individual parts.All these definitions have different views, but they usually make people be unable to agree or decide which is right,and even don't know what course to take .It's clear that it is unilateral to expain the human rights from only one angle.Moreover,some scholars thought that human rights is a moral right essentially.This difination revealed a certain ethical charactor of human rights,but it stated the concept from the angle of right,it's easy for people to make mixture with the concept of morality.Seeing that most scholars study the human rights in politics,law and right,the author of this thesis tries to make a definite concept of human rights and broad the seeing view. This project tries to probe into the idea of human rights in the view of philosophy and ethnics by using the ways of history and value analyse.The author learned from the experience of some essential research about the human rights,and drew lessons from the opinion of human rights is a moral right.Then concluded the moral meaning of human rights ,cardinged the view of value, moral principle and standard in human rights system and activities.It testified the academical possibility of Human Rights Ethics, and then expounds the conception and the character of Human Rights Ethics.The author excavated the main content and essence of the human rights ethical view of western and Marxism in the human rights history on the base of the definition of human rights concept,and took Marxism ehical view of human rights as guidance,combined the Chinese human rights present situation and practice,the author attempted to build the Chinese human rights ethics.The main ideas as follows. 1.The concept of human rights.Human rights produced with history,and it should embody the nature and society property of human.Basing on this ,the concept of human rights is that people have or should have a base right in a certain society history condition according to the nature and sciety property.It concludes moral right,legal right and fact right.The main content is mainly existing right and developing right and freedom and equal right basing on them.2.The concept and character of human rights ethics.Because there isn't a definition to the Human Rights Ethics in the sphere of learning at present,the author demonstrated the possibility of its establishing.The Human Rights Ethics established in its concept because the Human rights came from morality and revealed it,the ethics history was a history of human morality testifying itself,human rights realizing is a course of morality practice,and human riguts has a morality value. Human Rights Ethics means really the basic morality which hides in human rights itself,and the morality,value and ethical relationship which comes up in human rights activities,and even the sum of moral principles and standard which should be obeyed.The aim is to realize the human essence,freedom and all-around developing. Human Rights Ethics advocates that man should be treated as man,life should be cherished,man's dignity ,value and freedom should be respected,the love among people be emphasized.It also calls for man's equal and promotes man's all-around developing. Human Rights Ethics has a character of principle part,commonness and practice.3.The content of Human Rights Ethics.The main content of Human Rights Ethics is cherishment of life and respect of man's dignity.Its essential content is to respect man's freedom and equality.Its important content is to develop democratic spirit and love each other.The final goal is to promote man's all-around developing.4.The view of Western Human Rights Ethics.The author expounded the origin,form and perfect of Western Human Rights Ethics following the track of the developing history of Western Rights View,especially introduced the Western Human Rights thought of Grotius, Hobes, Lock, Rousseau, Kant, Hegel and Feuerbach, pointed out the essence of The view of Western Human Rights Ethics: (1).The expected premise is abstract man;(2).Regard individual as main character; (3)Regard the nature law as the value basis.5.The view of Marxism Human Rights Ethics.Marxism affirmed and sought Human Rights.It based on the criticism of the Human Rights view and the Human Rights Ethics of the bourgeoisie ,established the Human Rights Ethics of scientific socialism at the angle of man's liberation by sublating capitalism humantarianism.Marxism Human Rights Ethics regards the realistic interest as value direction,practice as the value evaluating basis,collectivism as value principle,so it's a comman siganificance.6.The theory building of Human Rights Ethics.We should regard the view of Marxism Human Rights Ethics as a guidance,put into effect the thought of three representative and the scientific developing view steadily,put Chinese human rights situation together with practice,regard the right, duty, collectivism and humantarianism as the ethical principle, cherishment of life and promote man's all-around developing as the main content,harmonious as the final goal,and establish the modern Human Rights Ethics.We hope it will be a reference to the establishing and development of human rights in China.
