Research On Relevant Systems Of Delegation Of Power To A Corporation In China

In modern country, the carrying capacity of the traditional"all-round government"is oppugned continually because of the extension of administrative power and the field of public administration. Correspondently, the unilateral comprehension about the origin, content, and performing method of administrative power in traditional administrative law theory is denied gradually. More and more people began to accept the developmental trend of social and administrative diversity. This trend gave birth to the phenomenon of delegation to a corporation. Obviously, it's both the result of impacts on the carrying capacity of the government from public affairs which are more and more diverse and complex and the needs of social diversity. The positive effects that enhancing the administrative efficiency and improve the quality of public services are fully emerged through administrative activities of the corporation which was delegated. But in the mean time, the worries about delegation to a corporation and the negative infections brought about by this phenomenon challenge the validity and justness of delegation to a corporation time and again. Therefore, it is necessary to make a research on this phenomenon, so as to ensure this phenomenon develop healthily and exert its function efficiently.This paper was doing research on the basis of the studies in being. The research methods include comparative method, demonstration method and logic analysis method. The research began with the reason of delegation to a corporation, then analyzed the obstacles faced the delegation to a corporation through the case of delegation to Shanghai Airport Authority, and conceived relative systems of delegation, execution and supervision. Besides the preface, the article can be divided into three parts as follows:Chapter One: the author defined two phrase's conceptions at first; they are"delegation"and"organization on commission". Then the author tried to analyze the reasons, practices, and theories of the phenomenon of delegation to a corporation in order to reveal the practical needs and theoretical foundations of this phenomenon.Chapter Two: in this part, depended on plentiful material, the author described the case of delegation to Shanghai Airport Authority. Through this case, the author found out and analyzed the obstacles of delegation to a corporation. This analysis also helps us mouse out how to the ways to conquer these obstacles.Chapter Three: on the foundation of above-mentioned description and analysis, the author followed the route of delegation, execute and supervision; conceived relative systems which could assure the goal and value of delegation to a corporation come true. These systems include the system of how to delegate to a corporation; the system of how a corporation execute the power delegated to it; and the system of how to supervise the corporation which was delegated.The phenomenon of delegation to a corporation involves many aspects, such as the design of relative systems and the connection between systems. We must consider these facts comprehensively, do research on this phenomenon continually and found the ways to exert the advantages of delegation to a corporation finally.
