Research On Well-known Trademark Anti-dilution And Its Civil Remedies

The well-know trademark dilution refers to the act of reducing identification and distinctiveness of well-know trademarks. Once the dilution appears, the identification of the trademark will be decreased even to nonexistence, and its distinction will be influenced greatly. Thus ,the function to identify the goods and represent band fame is limited and the value of the trademark is deprived as well. So it is quite necessary to regulate the dilution by law. By applying the basic principle of the dilution, analyze the situation that China has a long way to go to protect anti-dilution. Putting forward some proposals to improve the legal regulations for the protection of anti-dilution.The essay is composed of five chapters, chapter one, illustrate the theory of dilution and its development, analyze the legal problems concerning dilution and the corresponding negative influence on law and commerce;Chapter two, explain the reason of the dilution theory is the transference of the trademark function. It's reasonable because it is the necessary to balance the profits among the owner consumers and the publics;Chapter three, expand on the standards of dilution .For well-know trademark dilution, three requirements are necessary, namely, the behaviors of dilution, corresponding results, and the responsibilities.Chapter four and five, discuss the civil remedies of the dilution and put forwards some suggestions to improve the anti-dilution protection law of China.
