A Preliminary Analysis Of Improving The Villagers' Election System

The practice of the Household Contract Responsibility System in rural area, results in the disintegration of the original three-level management pattern forming by commune, production brigade and production team, and the system of self-administration of villagers is gradually coming into being. Self-administration of villagers has played a gigantic role in every aspect of rural area, such as public security and economic management. Among the various aspects of the Self-administration, the key is the villagers' election system. Therefore, in order to perfect the system of the Self-administration, the first important thing must be improving the villagers' election system. The villagers' election system, by which the villager committees are elected by villagers of their own will and in conformance with the law, is composed of a series of the concrete systems consisting of principle, procedure, method according to legal or norm relating to election, and it has acted as an important role in guaranteeing the democrstic rights of the villagers. The Organic Law of the Villager' Committees promulgated in 1998, lays out clear stipulations of the procedure to direct villagers' election and makes it standardization. Through exercising their democratic rights, millions of villagers have created many new patterns of election system by high political spirits, such as Sea Election, Two Votes System, Running for to form a cabinet, and so on. These achievements should be fully recognized. However, there still exists a lot of problems or disputes in the villagers' election system, such as the voters' qualification confirmation, the candidacy identification, government intervention by township, right of recall's performing, etc. These problems have become more prominent, and have impinged on the democratic rights of villagers to a certain extent.There are three parts in the writing: The summary of villagers' election system, the implementation and problems of villagers' election system and the improvement of villagers' election system. First is an introduction of the creation and the contents of villagers' election system, an analysis of the importance of villagers' election system to new countryside-construction and a generalization of the implementation of villagers' election system and the creations of villagers in practice. Then there is an analysis of the seven problems existing in villagers' election:The problem of the villagers' committees; the voters' qualification confirmation; the candidacy identification; the problems of electoral processes; the problems of ballot ; government intervention by township; right of recall's performing. Finally there is a suggestion about the improvement of villagers' election system from seven sides: Auditing the collective property before election; enacting electoral law of the villagers' committees; improving the system of supervision; standardizing candidacy condition and making it maneuverable; improving the electoral processes; improving remedy system regarding right to vote;improving unseating system. Strengthening guiding villagers' election: attracting the respected personages to self-administration organization by making good use of various resources; heightening villagers' enthusiasm and making clear the correct way to election; improving villagers' educational and legal levels with various measures.Based on analyzing the main problems, this thesis strives expound improving the villagers' election system, and to seek a realistic way to improve the villagers' election system, and tries to produce some useful views on the national legislation system.
