Legal Thinking On The Reform Of Post Enterprises

With the increasingly booming of the World Post reform, the continuously improved socialist market economy system and the termination of post profession protection according to the contract signed by the WTO and the Chinese government, the China Post is facing unprecedented pressure and challenge. The reform of China Post has been pushing to the verge of social reform. "Monopoly industries should carry out reforms to introduce competition mechanisms." has been clearly identified in the 16th Party Congress. In the Decision on Completing Some Issues of the Socialist Market Economic System Made by the Central Committee of the Communist Party of China, it has raised this question clearly, that was: Speeding up the reform of railway, post departments and city public-utility, following the policy of "separating the functions of government from those of enterprises, of capitalism and of institutions." Because of the present situation and the pressure mentioned above, China Post reform becomes increasingly imperative.Aiming at China Post situation, keeping in mind the post reform experience and characteristics in foreign countries and taking the enterprise restructuring and amending of Post Law as the main theme, this paper makes an overview on the world post reform, and discusses the main trends in the post development, the necessities, opportunities and ideas of China Post reform, and the completion of Post Law. This paper mainly investigates the existing problems and shortcomings in the system; the operation and management of Chinese post enterprises, with analyzing the opportunities the China Post facing, the author brings up his ideas and assumption about the reform of China Post. That is: It is necessary to fundamentally change the slow growth situation of China Post and we must carry forward the innovation spirit advocated in the 16th Party Congress. We have to get off the mixed situation of government and enterprises with the requirements of market economy and enforce the market operation and management of post enterprises. The problems of how to professionalize the management and enhance the competing power of post enterprises after the restructuring are also investigated. On purpose of make his own contribution to the reform of China Post, the author even expresses his personal ideas about how to amend some items of the Post Law.
