The Effects Of The Implement Of ISPS Code On The Improvement Of Our National Maritime Administration System

After the events of 9.11, especially since the Iraq War and the Afghan War, current world must face with the serious challenge of anti-terrorism. On the sea, terrors as ultra-nationalism, buccaneering, armed smuggle and stowaway emerge endlessly and even become badly, which indicates a long arduous mission of anti-terrorism in the world scope. Considering the austere situation IMO issued "International Ship and Port Facility Security Code" ( ISPS Code) being valid from Jul. 1, 2004 in order to keep away the security threat coming from terrorism at sea and other non-traditional domain. ISPS prescribes that all ships engaging in international navigation must have the security approval and get the "International Shipping Security Certificate" (ISSC) issued by authority organization. Otherwise ships will not be allowed to navigate between international maritime spaces and ports.The establishment of "International Shipping and Ports Construction Security Rules" hastened the processes of establishing and accomplishment the system of anti-terrorism at sea and dealing with other sudden accident in non-traditional domain in our country. According to the international security situation, our national government determined to respond and fulfill international obligation and liability by carrying out ISPS.On the other hand, the execution of new rules-ISPS submit strict requirement to the ability of our governmental maritime administration and shipping enterprises. Our national maritime administration system grow up into a kind of non-centralized system since the beginning of our country by which administration rights been divided into over ten departments. China Maritime Bureau which specific for executing ISPS is developing and adjusting to promote and enhance the maritime administration ability and efficiency under the requirement of law "Administration Permit". The establishment of ISPS brings profound effect to our country's administration system. This article will start with ISPS and analyze by comparing foreign country's maritime administration method with our experience and actual situation. Considering that most of the international laws realized through national port supervising system, whethercompelling or technical laws, this article will involve the national port supervising system and the special co-inspection system in our country.
