Conflicts of intellectual property rights include two parts: the virtual conflicts and the defective"conflicts". As to the conflict between trademark right and the right of trade name, the main scope of this dissertation focused on the behavior pattern and legal character of both rights, and the factors affecting their conflicts and the cognizance of trademark infringement.
