| Although the Criminal procedural Law has been amended, there still exist more and more design deficiencies and operation obstructions on related mechanism of official crime detect after years' justice practice. Along with the subscription of International Covenant on Civil and Political Rights, International Covenant on Economic, Social and Cultural Rights and UN Anti-Corruption Convention, the detecting mechanism has lagged a lot behind the new situation. It's urgent to reform correlative mechanism, or the deficiency as well as various obstructions will directly influence its detecting function. This thesis will expound some important concepts of official crime detect, the definition and characteristic of the mechanism. At the same time it will research on the main factors that influence and obstacle the efficient operation of the mechanism, such as the detecting concepts, information and clue management and so on. The practical procedure, from preliminary examination, filing a case to secret detecting, will also be concerned in this thesis. The inner deficiency and obstruction appearing in every part of the mechanism, such as the inner operation, related departments, detecting pattern, and so on will be analyzed by the author. Combining detecting theories and advanced detecting concepts and experiences at home or aboard together, so as to make it more scientific within the existing law system and bring forward a solution project pertinently, which is prominent for perceptiveness, operability and usefulness. |
