The paties' Autonomy of Will is a character and a basic principle of international commercial arbitration. But its scope is different in different phases of the development of international commercial arbitration, and different in different countries. Its expanding and restriction is related to a coutry's attitude to arbitration and policies the authority take. It is very important in the development of modern international commercial arbitration. There are some faultiness in our country's arbitration law.On above talking, this thesis takes the principle of Autonomy of Will as the angle of view. It maily uses the methods of historical analyzing, comparative analyzing and demonstrative analyzing, through the study of the historical development of The paties' Autonomy of Will in international commercial arbitration, and the review of international commercial arbitration agreement, application of law and several procedural issues, it estimates the trend of Autonomy of Will in international commercial arbitration, and it analyses the deficiency of our country's arbitration law, then gives some legal suggestions, aims to be helpful for the futher development of our international commercial arbitration.This thesis consists of five chapters.Chapter one talks about Autonomy of Will and the general theries of international commercial arbitration. firstly, it expatiates its formming, development and its connotation.Then it disgusses the relationship between Autonomy of Will and international commercial arbitration.This chapter makes a foundation for hereinafter disgussion.Chapter two disgusses Autonomy of Will and international commercial arbitraton agreement.
