Research On The Construction Of Chinese Medical Court

This paper, based on the situations of our country, is to study the construction of the medical court to promote the specialization of the trial on the medical dispute with the purpose of making the justice more impartial and efficient, making the sentences consistent to safeguard the judicial authority. But to construct a system is a complex job, which requires to think about many factors. Restricted by various situations, this article mainly focuses on the following questions:1st: the writer introduces national and aboard scholars' data on the administration of justice about the medical dispute and the author's research bases on the material. In this part the author points focal and difficult focuses as well as his creative ideals.2nd: the writer analyses the basic matters about the construction of the medical court jurisprudent. The definitions of justice and efficiency are presented, next the two-dimension-value unification theory—justice and efficiency in medical court is put forward, and accounts for that justice and efficiency can be realized simultaneously in the medical court. The theory of the specialty of the positions for judges in the medical court is established by analyzing the fundamental reasons of the judges' needing continuous training and the ways of their training.
