The theory of Joint crime has been considered as an important problems in the study and exploration of criminal law. In recent years,research on joint crime is especially attracted by crime science in civil law countries,and comes into being comparative matured,scientific joint crime theory and system,which is worth while of commending and reference.Our coutry is also civil law country, but start of research on joint crime is later,which leads to lots of difficulties and doubts in identification and disposal to joint crime,the relevant criminal legislation and theories need consummating efficiently.After reviewing,it is obvious that,because Taiwan region who adopts the Civil Law System,is influenced markedly by some typical Civil Law Countries like Germany,Japan etc.,it attracts the advantages of these countries adequately,improves its own Joint Criminal Theory,and has established comparative integrated and normative Joint Criminal System,that also shows the realistic significance to our Chinese Mainland.Therefore,The article might argue from these as well,combine with the problems existing in criminal legislation,theories and judicial practice in Chinese Mainland,and compare to criminal contents in Taiwan Region on Joint Crime concept,tenable important conditions,criminal subject,criminal type and crime modality etc.,and it also is necessary to refer to and consult Joint Criminal theories in Civil Law Countries like Germany and Japan etc..It is hopefully that,through comparing research on legislation and theories between two sides of the Straits,we can conclud a brand new view to Joint Crime,and thereby,discover the advantages of Joint Criminal theory in Chinese Mainland.
